1. What we agree to
These terms cover website design and development services provided by FuturByte to you, the client. Submitting a brief and paying a deposit through this site forms an agreement on these terms, alongside the specific scope set out in the blueprint we send you.
Where the blueprint and these terms disagree, the blueprint wins for that project.
2. Deposits and payment
Projects are quoted at a fixed price. 50% is payable up front to reserve a build slot, and the remaining 50% is payable on launch day, before code, domains and accounts are handed over.
Payments are processed by Stripe. We do not receive or store your card details.
Monthly items, such as a care plan, are billed separately once the site is live and can be cancelled with 30 days' notice.
3. Scope and changes
The blueprint we send within 48 hours of your brief defines the scope: pages, features, integrations and dates. Anything outside it is a change request, quoted separately and started only once you approve the new number in writing.
Each package includes a stated number of revision rounds. Additional rounds are billed at our standard rate.
4. Your responsibilities
We need timely feedback, content and access to third-party accounts to hit the dates in your blueprint. If material is outstanding for more than 14 days, we may pause the project and reschedule it into the next available slot.
You confirm that any content, images, trademarks or data you give us are yours to use.
5. Cancellation and refunds
You may cancel at any time. If you cancel before design work has started, the deposit is refunded in full. After design work has started, the deposit is refunded minus the work already delivered, calculated against the milestones in your blueprint.
If we cannot deliver the project, we refund everything you have paid for work not delivered.
6. Ownership
Once the final invoice is paid, you own the design files, the source code and the content of the site outright, along with all accounts and deployments created for the project.
We keep ownership of any pre-existing tooling and internal libraries used to build it, and grant you a perpetual licence to use them as part of your site. We may show the finished work in our portfolio unless you ask us not to in writing.
7. Warranties and liability
We fix defects reported during your package's support window at no charge. Beyond that, the site is provided as is, and our total liability is limited to the fees you have paid us for the project.
We are not liable for indirect or consequential losses, including lost profit or lost data.
8. Governing law
These terms are governed by the laws of the jurisdiction in which FuturByte is registered, and disputes are subject to that jurisdiction's courts.
