Website Design in Miami: The Laws That Reach the Page Itself
Florida statutes, federal agencies and sector regulators all reach a Miami business website. Here is what they actually require, and what it costs to ignore them.

Most conversations about a Miami website are about look, speed and leads. In the United States, and in Florida in particular, a lot of what your site must do is decided by statute rather than by taste. A contact form, a testimonial wall and a subscription checkout are all regulated objects. Getting them wrong is not a design critique, it is a demand letter.
Three layers of rules reach the page
Federal law, enforced mainly by the Federal Trade Commission and the Department of Justice. Florida law, enforced by the Office of the Attorney General and by private plaintiffs. And whatever regulator governs your licence, which in Miami is usually health, real estate, insurance, law or money services. None of this is legal advice, but it is what to ask a Florida attorney about before you commission a build.
Owners underestimate the private plaintiff. The Florida Deceptive and Unfair Trade Practices Act (Fla. Stat. 501.201 and following) gives consumers a private right of action, and a prevailing party can recover attorney's fees. That fee shifting is why an overstated claim in your hero copy deserves more care in Florida than elsewhere.
Accessibility is the exposure that actually gets litigated
There is still no federal regulation telling a private business exactly what an accessible website looks like. Courts apply Title III of the Americans with Disabilities Act by analogy, and the Southern District of Florida, which covers Miami-Dade, has for years been one of the busiest venues in the country for web accessibility filings.
The working standard is WCAG 2.1 Level AA, because that is what settlement agreements keep specifying. Accessibility has to be designed in, since contrast, focus order, form labelling and heading structure are design decisions before they are code. An overlay widget is not a defence: sites running one have still been sued.

The moment a form collects a phone number and someone follows up with an automated text or dialler call, you are inside the federal Telephone Consumer Protection Act and the Florida Telephone Solicitation Act (Fla. Stat. 501.059). In January 2025 the Eleventh Circuit, the appeals court covering Florida, vacated the FCC's one-to-one consent rule in *Insurance Marketing Coalition v. FCC*. That is a reprieve for lead generation forms rather than permission. If you buy or sell leads in Miami, the consent language on the form is what gets scrutinised.
Because so much Miami business runs to and from Latin America and the Caribbean, WhatsApp click-to-chat is often the highest-converting contact route on the page. It carries the same consent duties as any other outbound channel, even though it feels like a personal conversation.
What Florida and the FTC make you disclose
- Sensitive and biometric data. The Florida Digital Bill of Rights, in force since 1 July 2024, reserves its full controller duties for very large companies, but a business selling sensitive or biometric personal data must post the capitalised notice the statute prescribes. Most Miami small businesses do not sell such data, and should confirm their pixels and vendors are not doing it for them.
- Automatic renewals. Fla. Stat. 501.165 requires clear disclosure of auto-renewal terms and an online cancellation route for anything bought online. ROSCA still governs negative option offers federally, even though the FTC's broader click-to-cancel rule was struck down in court in 2025. The cancel path is a designed screen, not a support email address.
- Reviews. The FTC's rule on consumer reviews and testimonials, effective from late 2024, bans fake and undisclosed incentivised reviews, and the revised Endorsement Guides govern how you present the real ones.
- Email. CAN-SPAM requires a valid physical postal address in commercial email and an unsubscribe honoured within ten business days.
- Breaches. The Florida Information Protection Act (Fla. Stat. 501.171) requires notice to individuals within thirty days, and notice to the Attorney General at five hundred or more Floridians. That is tighter than many states, so logging belongs in the build.
- Payment pages. PCI DSS 4.0.1 requirements 6.4.3 and 11.6.1, mandatory since 31 March 2025, govern which scripts may run on a page taking card data. Marketing cannot drop tags freely onto checkout.

Given how much of Miami's legal market is contingency-fee personal injury, this is where a designer's instinct for a big confident claim collides with the rules fastest.

A majority of Miami-Dade residents speak Spanish at home, and Haitian Creole is the county's third language by a wide margin. Florida's constitution names English the official language, and no statute obliges a private business to publish in another. But the FTC's long-standing position is that a disclosure is not clear and conspicuous if it appears in a different language from the one in which you made the sale. If your ads and landing page are in Spanish, so are the terms, the consent text and the cancellation instructions.
That means separate URLs per language with hreflang set correctly, translated form validation, translated legal templates, and a language switch that keeps you on the same page. Organisations taking federal funding, including many Miami clinics and social service providers, also carry Title VI language access duties, which pushes the requirement into Haitian Creole.
